Introduction

The POSH Act, 2013 — formally known as the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act — was formulated to ensure a safe and secure working environment for women. The legislation gives statutory recognition to the guidelines laid down by the Supreme Court in Vishaka v. State of Rajasthan, (1997) 6 SCC 241, where workplace sexual harassment was held to be a violation of the fundamental rights guaranteed under Articles 14, 15, 19(1)(g), and 21 of the Constitution of India.

While much of the discourse around the POSH Act focuses on the Internal Committee, an equally vital — and often overlooked — functionary is the District Officer, whose powers and duties are laid out under Section 20 of the Act.

Who Is the District Officer?

The District Officer is appointed under Section 5 of the POSH Act by the appropriate Government. This role becomes especially important in:

  • Workplaces with fewer than ten employees, where the Internal Committee requirement does not apply, and
  • Cases where the complaint is made against the employer themselves.

In such situations, the District Officer acts as the key administrative authority responsible for ensuring redressal and compliance.

Functions of the District Officer Under Section 20

1. Overseeing Enforcement and Awareness

The District Officer is responsible for monitoring the overall enforcement of the Act and promoting awareness of its provisions relating to the prevention of sexual harassment.

2. Ensuring Formation of Internal and Local Committees

One of the most significant duties is to ensure that:

  • Every workplace with ten or more employees constitutes an Internal Committee (IC), as required under Section 4.
  • Where an Internal Committee is not required, or is unable to function, a Local Committee (LC) is duly constituted under Section 6.

3. Conducting Awareness Programs

The District Officer must organize awareness campaigns, workshops, and training programmes aimed at educating employers, employees, and the general public about the provisions of the POSH Act.

4. Monitoring Annual Reports and Records

The District Officer must ensure that the Local Committee submits its annual report under Section 21, and maintains proper records of:

  • Complaints received
  • Inquiries conducted
  • Actions taken
  • Awareness activities carried out

This reporting mechanism ensures government accountability and allows for periodic evaluation of how effectively the Act is being implemented.

5. Facilitating Investigation and Redressal

It is the District Officer’s duty to ensure that complaints received by the Local Committee are properly investigated and remedied. Where administrative assistance is needed during an inquiry, the District Officer must extend the necessary support — helping ensure that the victim is not subjected to further victimization during the process.

6. Coordinating With Other Bodies

The District Officer is also required to collaborate with government departments, local bodies, and NGOs to widen the reach of awareness efforts around the Act.

Judicial Reinforcement: Aureliano Fernandes v. State of Goa

The importance of effective implementation of the POSH Act was reiterated by the Supreme Court in Aureliano Fernandes v. State of Goa, (2023) 7 SCR 772. The Court noted widespread non-compliance with the mandatory provisions of the Act by several institutions and directed that all governments and relevant authorities ensure:

  • Proper constitution of Internal Committees,
  • Regular awareness programmes, and
  • Overall compliance with the statute.

This judgment reinforced the significance of the supervisory role of the District Officer under Section 20 in ensuring that the Act functions as intended, rather than remaining a provision on paper.

By exercising supervisory powers — from ensuring the formation of Internal and Local Committees to monitoring complaint redressal and driving awareness — the District Officer plays an indispensable role in making workplaces across the country safer and more dignified for women.
