
The ministry of electronics and information technology under the Central Government has issued a stern notice to ‘Meta on child sexual abuse’ ads on Instagram. The ministry has asked the parent body of Instagram, Meta to disable the advertisements and contents which promotes Child Sexual Exploitative and Abuse Material (CSEAM) and also sought a detailed explanation on the action taken so far to remove such content on the platform within seven days.
BACKGROUND:
The notice was issued a day after the BBC Eye published an investigation which revealed that allegedly there has been running “paid adverts promoting child sexual abuse material in India” on Instagram. That these advertisements provide links for Telegram Channels where they could buy the child sexual abuse materials.
LAWS AND POLICIES:
Meta’s policy mentions a stringent compliance to the guidelines and mentions that the advertisements must “comply with the community standards on adult nudity and sexual activity. Ads must not contain imagery depicting nudity, sexual activity, depictions of people in explicit or sexually suggestive positions, or activities that are sexually suggestive”.
Moreover section 67, 67A and 67B under IT Act, 2000 penalises acts which involves publishing or transmitting obscene material, sexually explicit material and contents showing children in sexually explicit acts in the electronic form. Offences under section 67 are punishable with imprisonment extending up to three years with a fine which may extend up to Rs. 3 Lakh on the first conviction and on event of subsequent conviction with an imprisonment extending up to five years and a fine up to Rs. 10 Lakh. Meanwhile, under 67A and 67B are punishable with imprisonment extending up to five years and fine up to Rs. 10 Lakh on first conviction and which can on second conviction extent up to 7 years of imprisonment and a fine up to Rs. 10 Lakh.
The IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 enforces obligations on intermediaries to observed due diligence. The intermediaries are required to remove any such contents within 24 hours and any failure in doing so they lose the exemption under IT Act for the third-party information.
